Prenup (Prenuptial Agreement)

A prenuptial or antenuptial agreement is a contract between two people who, prior to marriage, wish to pre-determine how finances and division of assets will be handled in the event of divorce or death.

A postnuptial agreement is a contract between two married individuals who would like to make these same pre-determinations.

The basic requirements of a valid prenuptial or postnuptial agreement in Minnesota are:

  • Full and fair disclosure from both parties.
  • Both parties must have their own, separate attorneys to ensure full understanding of how their legal rights may be impacted by the agreement.
  • The document must be fair.
